I couldn’t see anything in here about how it is determined who is an insurecctionist. It’s obvious to me, but no one is calling me to get my opinion. Seems like a law with no way to enforce it
The matter is that as long as he has not been convicted, he is presumed innocent.
Only a court can name him an insurrectionist. And it is very frail as long it is not a penal court.
And a decision of a court, except a penal one or a federal one, has no effect beyond its juridiction. (Well, i don’t think it is absolute but i don’t enough know the US legal system to go further).
Will supreme court do it?
Well, technically Trump is presumed innocent until proven guilty, but Trump has managed to indict himself and has in effect already “plead” guilty to several felony crimes
He just doesn’t see them as crimes and that’s what makes him unfit as President.
