In Part 1 of Court Accountability Action’s roundtable featuring Judge J. Michael Luttig, take a look at the Trump-enabling decisions of the U.S. Supreme Court.
Republicans have been planning this takeover for decades. Their plan will be tested in a week. This is when we find out if we can keep our republic. It’s all coming soon and appears to be razor thin. We (wife and I) have done all we can do. We have popcorn.
I will be out of country. Hopefully I get let back in. I give it a week (after the votes) before we know anything. Then we might have something like the FL recount of 2000, and a SCOTUS intervention. But it won’t end there. The ceremonial certification of the electorate will be covered live. Swearing in will be the most security we’ve ever seen.
Trumps mental health will decline. He will eventually be replaced in some way. Maybe gerrymandering will get better, maybe down ballot wins for Democrats. My crystal ball has never been very good
SCOTUS accepting undeclared financial benefits is not subject to “like”. It’s illegal!
It is a written law.
SCOTUS Argument and Review
Federal law prohibits federal officials from accepting anything of value for any official act (this is codified at 18 U.S.C. §201). There are two relevant sections for the federal provision: §201(b), which prohibits bribes and requires that the giver or receiver act “corruptly,” and §201(c), which prohibits gratuities because of official acts (without a requirement that the giver or receiver act “corruptly”). The statute at issue in this case, 18 U.S.C. §666, was enacted to extend the prohibition on bribes and gratuities to most state and local officials. Section 666(a)(1)(B) makes it a crime for state and local officials to “corruptly” solicit, accept, or agree to accept anything of value intending to be influenced or rewarded in connection with any official business or transaction worth $5,000 or more. The maximum punishment is ten years in prison.
It is very unlikely they will be involved in this election. Even if they did get involved, there is absolutely no reason to think they will be working to wreck Harris.
Why it matters: Regardless of how the court rules, it could anger Americans on either side of the nation’s political divide, and further damage the public’s historically low trust in the Supreme Court.
